Ontario constructors are asking an important question as January 1, 2026 approaches: Is an AED required on this project?Under Ontario Regulation 157/25, the answer depends on two specific conditions that must both be met.
An AED is required on a construction site when 20 or more workers are regularly employed and the project is expected to last three months or longer. When both thresholds apply, AED compliance becomes mandatory under the Occupational Health and Safety Act (OHSA). Many commercial, industrial, infrastructure, and large residential projects across Ontario already fall within this scope.
Projects lasting less than three months may be exempt; however, inspectors assess actual site conditions, not original estimates. If staffing levels increase or timelines extend, a project may unexpectedly become subject to AED requirements. Delaying AED planning can expose constructors to enforcement orders or work disruptions.
